Copyright and the old family photo | The Legal Genealogist ...

First in an occasional series on copyright ? the old family photo

The photograph you see to the left here is of my grandmother, Opal (Robertson) Cottrell. Isn?t she adorable? Offhand, I?d say she might be all of two years old in this image, so it was probably taken around 1900.

It was probably taken in Granger, Williamson County, Texas. That?s one of the two studio locations for the photographer, and that?s where her grandmother Martha Louise (Shew) Livingston was living in 1900. Martha and her last husband, Abigah Livingston, had their own photo taken at the same studio, most likely at the same time.

Let?s see here? 2012 minus 1900? that photo was taken 112 years ago. I own this copy of the photo. The person depicted in it is my grandmother. Nothing to worry about in using this photo, is there?

After all, most people will tell you that any photograph or other work created before 1923 is now in the public domain, meaning that there aren?t any copyright restrictions and anybody can make use of it.

Great! My grandmother?s picture was certainly created before 1923, so it?s public domain and I can do whatever I want, no?

No. As a matter of fact, were it not for the concept of fair use,I?d be violating the copyright of the photographer who took this picture by using it here in this blog.

Pretty mind-boggling, isn?t it? I own this copy of the photo, it?s a picture of my own grandmother, and yet the law severely limits what I?m allowed to do with it.

That?s because ? drum roll, please ? ownership of the photo is not the same thing as ownership of the copyright.

Under the law, if an item is protected by copyright, then only the copyright owner gets to say who can and can?t copy it or use it. And the mere fact that the copyright owner sells or gives away copies of the item doesn?t mean the copyright goes with it.

If I take a photograph, I can sell you a copy and keep the copyright. You can display the photo in your home or your office, but the only one who can make more copies or publish it or use it in a whole bunch of other ways is me. I can print hundreds of copies and sell them all, and none of the buyers has any right to re-copy or re-publish the work. I could even sell you one copy for your home, sell the right to make copies for public sale to your cousin, and sell the right to hang the photo in public to your cousin?s husband?s buddy.

What that means for this picture of my grandmother is that even though the photographer sold the photo to someone in my family (I?m betting it was Martha Louise who paid for it ? my grandmother was her first grandchild), and even though the picture was passed down through my family and a copy ultimately came to me, the only way I can use the picture any way I want is if the copyright on that photo has expired.

How do I know that it hasn?t?

Here?s the story:

Because of a number of amendments and changes in copyright law, what is and isn?t covered by copyright depends on two things: (1) when the item was created; and (2) whether it was published. Here?s a general outline of the key dates under the law:

So? why isn?t this 1900 photo in the public domain? Because it had to have been created and published before 1923. And there?s not one bit of evidence it was ever published as that word is used in the law:

?Publication? is the distribution of copies ? of a work to the public by sale or other transfer of ownership, or by rental, lease, or lending.

And when it comes to photographs, making a single print for the person photographed does not constitute publication. Even if the photographer hangs it up in his window as a display piece to entice others to come into his studio, it won?t help:

A public ? display of a work does not of itself constitute publication.

Under current U.S. law, for any unpublished work created before 1 January 1978, the copyright lasts for the lifetime of the creator plus 70 years. Hmmm? That photo was taken 112 years ago, and the photographer had to be an adult when it was taken, so time is running fast, no? No. Frank J. Schlueter, principal of the studio where the photo was taken, was born in Germany in March 1874. And he died in Texas on 7 December 1972. I have 30 years to go before I can use that photo in any way and for any purpose I want.

But I mean, really. Nobody is alive today who could possible chase me for using this copy, no? No again. ?Ownership of a copyright ? may be bequeathed by will or pass as personal property by the applicable laws of intestate succession.? Whoever has the rights to his estate has this copyright too.

But wait a minute. There are other photos from this studio out there on the web, some even on Flickr from respected institutions like Southern Methodist University. Nobody?s chasing them, right? And there are all kinds of photos online at the Library of Congress! Yeah. That?s true. And you should really take the time to read what the Library of Congress says about the photos it owns and puts in its digital collections. You?ll find its overview here. And the bottom line there is that ?The Library is unaware of any lawsuits involving the use of its historical images.?

Just my luck, the case against me would be the first one?

Sigh? I?d better still be alive and kicking in 2042?

Fall of Mayawati, India's low-caste 'Dalit queen'

Mayawati, India's low-caste "Dalit queen" who once saw herself as a future prime minister, was dethroned on Tuesday after a colourful and scandal-tainted term running the country's largest state.

The firebrand chief minister of Uttar Pradesh was set to lose office after her Bahujan Samaj Party (BSP) fell to a projected 86 seats in the 403-seat state assembly after winning 206 in the previous election.

Mayawati, 56, who only uses one name, rose from a community of "untouchables" (now known as Dalits) at the bottom of the Hindu caste structure to rule over Uttar Pradesh, a state in northern India with a population of 200 million.

She attracted strong support from Dalits and other marginalised groups who saw her as a doughty champion of the poor fighting against the ruling elite in New Delhi.

Styling herself as a "living goddess", she has often attacked the Congress party government as a corrupt and self-serving cabal that failed to tackle India's endemic poverty.

But she also drew sharp criticism for her own taste for extravagance, as well as allegations of financial malpractice within her state government -- both issues seen as major factors in the dramatic collapse in support for her.

Born into a "Chamar" or leatherworkers' family on the outskirts of New Delhi in 1956, Mayawati was studying law when she was talent-spotted by the then BSP president Kanshi Ram in the mid-1980s.

Ram persuaded her to join politics, telling her "she was born to rule" rather than to serve.

Within a decade, Mayawati had become chief minister of Uttar Pradesh for the first of her four stints in power as she battled for control in the turbulent world of politics in the northern state.

Her latest -- and by far longest -- term in office, which began in 2007, has overseen some economic development, as well as huge controversy over her building parks full of huge statues of herself and other past low-caste icons.

Public records show that more than a billion dollars was spent on the projects, but Mayawati has always brushed off allegations of arrogance, saying the parks acted as a "lighthouse" for down-trodden Dalits.

Her long-term adversary Mulayam Singh Yadav, whose Samajwadi Party was set to defeat her by a thumping margin in the elections, has often vowed to raze the parks.

Yadav, a former wrestler now aged 72 famed for his ferocious rivalry with Mayawati, is in line to become chief minister for the fourth time since 1989.

In opposition, Mayawati is likely to be a dogged opponent, but she will be shorn of the influence and power that critics say went to her head and turned her into a "first-rate egomaniac," in the words of a leaked US diplomatic cable.

The US cables released last year by the WikiLeaks website recounted a story in which she was said to have sent her private jet to pick up a pair of sandals from Mumbai.

The cables also alleged that she celebrated her birthday each year by receiving millions of dollars from "sycophantic party members, civil servants and business people", while officials vied to feed her cake.

Mayawati hotly denied all the allegations and demanded that WikiLeaks founder Julian Assange be thrown in a mental asylum.

The former school teacher, who in recent years has toned down her dress style after previously dripping in diamonds, drew enthusiastic crowds on the campaign trail.

Carrying her trademark handbag, she used her speeches to hail the improved status of Dalits and -- seeking to broaden her appeal -- also promised further help for the millions of often marginalised Muslims.

Mayawati, who is unmarried, may have hoped that large turnouts at her rallies pointed to another term in office and a step towards a bigger role on the national state.

But Tuesday's results showed that the reign of the "Dalit queen" was over for now.

We saw many new advances in this area of ??the Wii Remote, so you physically ?swing? Kinect a golf club, or the world, actually detects your body movements to interact in the world of games. This means a user of the console could exercise a little more than an ordinary PC gamers.

In addition, there are some games that might not work on consoles, like strategy games. These games rely heavily on the use of a computer mouse to select units and commands.

There are many advantages to PC games and console games, and there are certain games that are played on both platforms, without the ability to switch from one type to another. It is a question of degree of commitment or diving requires that each player gets the game itself.

Oscars wins boost "Artist," "Separation," "Undefeated"

LOS ANGELES, March 4 (TheWrap.com) - A week after taking home the gold, a handful of Oscar-winning movies are raking in the green.

"The Artist," which won five Academy Awards, including best picture, last Sunday, grossed $3.9 million -- more than 10 percent of its domestic total so far -- this weekend.

That was enough to make the mostly silent, black-and-white film the No. 10 movie in America. The movie was No. 11 on Super Bowl weekend, but this is its first appearance in the top 10.

"This is a testament to the playability of this film," Erik Lomis, The Weinstein Company's chief of distribution, told TheWrap Sunday. "It's in its 15th week, and people are starting to find out about it in the smaller markets."

Indeed, The Weinstein Company increased the number of locations showing the film from 966 last weekend to 1,756 this weekend. Lomis said he expects to keep the PG-13-rated movie in the same number of locations next weekend.

"A Separation," the PG-13 Iranian movie that won the Oscar for best foreign-language film, took $1 million -- 173 percent more than it grossed last weekend -- in its 10th week of release, according to Rentrak.

Sony Pictures Classics expanded the number of locations showing writer-director-producer Asghar Farhadi's movie from 83 last weekend to 243 after the Oscars. It has grossed $3.7 million.

The documentary "Undefeated" took $84,211 in its third week of release.

The Weinstein Company, which is distributing "Undefeated," expanded the number of locations showing the Oscar-winning movie from five to 13. The Oscar win and theater expansion increased the film's take by 337 percent over last weekend.

The company's "The Iron Lady," which earned a surprise best actress Oscar for Meryl Streep, took $900,000 -- 29 percent more than it took last weekend -- on 511 screens. The PG-13 biopic of Margaret Thatcher, the former prime minister of Britain, is in its 10th week in release.

"The Descendants" won a best adapted screenplay Oscar but is finally beginning to lose steam at the box office. Fox Searchlight reduced the number of locations showing the movie from 889 to 694.

Still, the R-rated movie took just short of $1.4 million over the weekend. Now in its 16th week of release, the film has grossed nearly $80.5 million.

Among new specialty releases this weekend, Focus Features' "Being Flynn," starring Robert De Niro and Paul Dano, opened to $45,546 at four locations.
